Following more than three years of work the county is preparing to adopt the much anticipated Tier Overlay System. This system has been designed to both simplify and modify the current growth management tool known as ROGO (Rate of Growth Ordinance). The Board of County Commissioners will have a new map book product before them on March 15th 2006 at the Marathon Government Center. A second hearing will be held on March 17th at the Harvey Government Center in Key West, and a third in the Key Largo Library on March 21st.~ This map book displays the entire area of Monroe County which will be subject to the Tier System. The proposal includes a total of four tiers: Tier 0 = Submerged Land & Right of Way, Tier 1 = Conservation, Tier 2 = Transition (Big Pine Key Only), Tier 3 = Continued Development, Tier 3 (Special Protection Area) = Hammock
Areas and Tier 4 military lands. This new map book product is available for download and review.
Over the past 4 years of Tier System development Monroe County Growth Management has accepted applications for Tier designation review. If a citizen thought that their property had been incorrectly placed in one Tier or another they could apply for a review by the Division. The final review of the 300 plus applications took place in late February of 2006 and 147 errors were identified. The Monroe County Board of County Commissioners passed Resolution 148-2006 in early March of 2006 directing staff to correct these 147 errors at the first opportunity. That first adoption of the Tier System into the Land Development Regulations was appealed. This appeal rendered it impossible to change Tier Designations for any parcel.
A regular meeting of the Monroe County Planning Commission will be held on December 6, 2006. One item on the Commission's agenda will be a resolution to amend the Monroe County 2010 Comprehensive Plan to include the Tier Map Overlay. Staff is also asking the Commission to review and amend the Tier Overlay Map to resolve these 147 errors prior to adoption. The Planning Commission will render a recommendation and send forward the proposed ordinance to the Monroe County Board of County Commissioners. The Planning Commission recommendation and the proposed Comprehensive Plan amendment will be heard at the special meeting of the BOCC on December 8, 2006 with a second hearing prior to transmission to the Florida Department of Community Affairs on December 18, 2006.

In the two months since adoption by the BOCC of the new Tier System, Growth Management has been working diligently to prepare for implementation. In an effort to keep the public and our customers better informed on the changes we have prepared a series of pamphlets called the Layman’s Guide. The series covers four topics thus far, The Residential Development Process, The Commercial Development Process, The Rate of Growth Ordinance (ROGO), and Development on Big Pine and No Name Keys. The series should serve as an excellent start for understanding our systems of development approval. Another tool we have prepared to help our customers understand the upcoming changes to ROGO is a newsletter called the ROGO Updater. This newsletter covers topics related to ROGO scoring and ranking in depth and with excellent detail. It will guide you through the submittal requirements for a ROGO application and if you have already submitted an application and are awaiting an allocation it will inform you on how we will be rescoring your application. We are also making available the four ordinances and 1 resolution approved by the BOCC in March relating to the Tier System and its implementation. The ordinances are 009-2006 dealing with the changes to ROGO, 010-2006 setting the criteria for Tier designation and the amendment process, 011-2006 dealing with the changes to NROGO, 012-2006 enacting a temporary deferral for all new development applications, 013-2006 adopting the Tier Map Document and its
designations, and resolution 148-2006 which approves a plan to amend the Tier Map Document post implementation to correct known errors as identified by staff.
